Howard K. Stern’s charges are thrown out of court

Charges of drug consiracy of the late Anna Nicole Smith, between boyfriend, Howard K. Stern and psychiatrist, Khristine Erosevich. Judge Perry only left one charge and reduced it to a misdemeanor. The judge ruled that Stern was only trying to protect Smith’s privacy and that is why a different name was used.

Judge Perry sentenced psychiatrist, Dr. Khristine Erosevich to one year probation her role in the death of the star as well. Erosevich was charged in fraud as well for obtaining one Vicodin prescription under a false name.

Both were ordered to do community service as well.

Judge Perry stated that the case did not have sufficient evidence. District Attorney Steve Cooley stated that there will be an appeal of the ruling and that he strongly disagrees with the verdict.

Smith died in 2007 in a Florida hotel which was ruled an accident and the defendants were not charged with her death.

The judge presiding over the case against Anna Nicole Smith’s former boyfriend, Howard K Stern, dropped several of the charges against him. The prosecutors in turn have been accused of essentially overcharging him, however. The judge said that in the 622 jury trials he has presided over, there have only been three times where he was faced with “overzealous” prosecutors who “appeared to put winning above” fairness. The judge tossed charges against Stern for obtaining drugs by fraud and deceit as well as part of a conspiracy count against Stern, saying there is no proof of conspiring.

Anna Nicole Smith’s psychiatrist, Dr. Eroshevich, had gathered 44 different precription drugs from her Bahama’s house in the Bahama’s. Many of the prescriptions were painkillers, opiates and sleeping medications. Methadone, phenobarbital, Valium antibiotics and Tylenol were among some of the drugs found.

This is coming to light due to the current conspiracy trial of the psychiatrist, a doctor and Smith’s boyfriend-lawyer. Eroshevich, Dr. Sandeep Kapoor and Stern have pleaded not guilty to conspiring to provide Smith excessive amounts of opiates and sedatives; They have not been charged with her death.

A chart prepared by Schueler showed the medications were prescribed by numerous doctors, including some in the Bahamas, with many of the labels showing pseudonyms for Smith, including Michelle Chase, Susie Wong and Jean Smith.

Anna Nicole Smith’s baby daddy, Larry Birkhead, told a court yesterday that he thought the Playboy model was taking too many drugs before she died — including while she was pregnant with their daughter, Dannielynn.

“I felt she took medication in excess,” he testified at a preliminary hearing to see if Smith’s former doctors, Sandeep Kapoor and Khristine Eroshevich, and her lawyer, Howard K. Stern, should stand trial for giving her too much prescription medication before her 2007 death.

“I felt like she was addicted to methadone,” Birkhead said.

He said Stern was always asking her if she had taken her meds. Birkhead also testified that Smith had bottles of methadone in the house.

Anna Nicole’s Final Days

Anna Nicole Smith was ill, confused and isolated in a hotel room with a cornucopia of prescription drugs in the days before her death, an investigator testified Tuesday in a criminal case stemming from the celebrity model’s overdose death.

California Department of Justice investigator Danny Santiago testified that witnesses said Smith was unable to walk unassisted into the Florida hotel, and she was so weak she could not sit up to drink liquids.

The testimony was presented in a preliminary hearing involving charges that Smith’s former lawyer-boyfriend Howard K. Stern and two California doctors conspired to illegally provide Smith with controlled substances before her drug-overdose death at age 39.

Superior Court Judge Robert J. Perry, who will decide if there is enough evidence to send the case to trial, noted the defendants have not been accused of killing Smith and questioned the relevance when prosecutor Renee Rose asked Santiago about Smith’s cause of death.

“There is not a murder charge,” Perry said. “The cause of death is not an issue.”

Anna Nicole Smith Investigated in Murder Plot

Before she died in 2007, Anna Nicole Smith was investigated by the FBI in connection with an alleged murder plot against the son of her late oil tycoon husband, but the former Playboy Playmate was never prosecuted.

According to documents obtained by The Associated Press, the FBI investigated Smith in 2000 and 2001 in a murder-for-hire plot targeting E. Pierce Marshall. Marshall fought to keep Smith from inheriting his father J. Howard Marshall’s multi-million dollar estate after he died in 1995, less than a year after marrying Smith.

The case bounced around the courts for years until the Supreme Court unanimously ruled in May 2006 that Smith could pursue her late husband’s fortune. The younger Marshall died a month later from an infection. Smith died the following year, in February 2007, from a drug overdose.
