Halle Berry and Ex continue to battle over their daughter.

On Tuesday Halle Berry made an appearance in family court accusing her ex, Gabriel Aubry, of violating the custody agreement for their 3 year old, Nahla.

The actress is reportedly accusing Aubry of neglecting their daughter on an overseas visit and putting her safety at risk. Aubry was not in court, so the judge has scheduled a hearing for a later date.
“Halle has serious concerns for her daughter’s well-being while in the care of her father for any extended period of time and is prepared to take all necessary steps to protect her,” the 44 year old actress’ rep told sources.

“Halle has always made the needs and safety of her daughter her first priority and, both while Halle and Gabriel were a couple and since their break-up, Halle has only acted in her daughter’s best interest,” the rep continued.

The two dated for several years before ending their relationship in April 2010.

Halle Berry rejoins “New Year’s Eve”

Reportedly, Halle Berry has decided to rejoin the cast of the romantic comedy “New Year’s Eve”.

Berry will take a smaller role and production is currently underway.

The film is a spin off of Garry Marshall’s “Valentine’s Day” and is set in New York. Katherine Heigl has replaced Berry in her original role we have learned.

According to sources, the judge ruled that Berry could take daughter, Nahla, to New York while making the film. “New Year’s Eve” is scheduled to be released on December 9, 2011.

Actress Halle Berry’s ex-boyfriend, Gabriel Aubry, father of her 2 year old daughter, Nahla, has filed to end his custody case. Reportedly, Berry and Aubry have decided to set aside their differences for the sake of their daughter.

On December 30, Aubrey filed for joint custody of Nahla. The couple dated for five years before the split. A source has said, “I think both sides realized how out of hand things had gotten recently. They both love their daughter and want to make sure her welfare comes first. Gabriel and Halle have spoken to each other and have committed to try and make things work, without the courts — Gabe’s decision to drop his case is his way of showing Halle he’s prepared to take a leap of faith and trust her once again.”

According to sources, Berry is making it easier for Aubry to spend time with Nahla. The source said, “Hopefully this is the start of the two of them being able to form some kind of workable co-parenting relationship for the sake of their daughter.”

Halle Berry told sources that her daughter is “black”.

“Being a mother is probably the most important thing in my life right now,” Berry, 44, told sources. “Career is important, but nothing really supersedes my roles as a mother,” she explained. “That’s the most important thing I’m going to do in this life at this point.”

According to the actress’ representatives, Berry was “forced to pull out of a film production in New York this week due to pending custody litigation involving” her daughter Nahla, 2, and her ex Gabriel Aubry.

During an interview, Berry said [of her daughter], “I feel like she’s black”. She went on to say “I’m black and I’m her mother, and I believe in the one-drop theory”.

Berry said that Nahla will one day have to decide if she wants to be labeled, and went on to say, “If you’re of multiple races, you have a different challenge, a unique challenge of embracing all of who you are but still finding a way to identify yourself, and I think that’s often hard for us to do”.

Sources have said that Aubry, 34, sees Nahla as being “white” and allegedly gets angry when she is otherwise charaterized.

Berry is not sharing the messages with the press, but he is saving them for the upcoming custody battle for their 2 year old daughter, Nahla.

“I honestly think Gabriel should release some of these messages he has from Halle and tell his side of the story, but he won’t,” a source says. “He said he’s going to save them for family court, which will be a private, press-free environment.”

Sources say Berry is pulling out of upcoming film “New Year’s Eve” so she can clear her schedule for the battle ahead. “Halle Berry was forced to pull out of a film production in New York this week due to pending custody litigation involving her daughter,” her rep said. “She attempted to resolve these custody issues amicably with her daughter’s father, Gabriel Aubry, directly, but given his lack of cooperation, Halle has no choice but to seek swift judicial intervention.”

He will not attack Berry in the press because “he knows attacking Halle in the press would ultimately do that,” says the source.

Sources say, “she left a crazy message on Gabe’s cell just after some pictures came out of him at a Lakers game with a girl last year. She is mega, mega p***ed in the message, calling him, and the girl, all kinds of names. It’s certainly something Halle wouldn’t want heard. Gabriel played it to me at the time, and said: ‘See what I have to deal with?’”

Berry and Aubry supposedly had a amicable split in April, 201 and described themselves as “still friends”. Things got trickier when Aubry filed papers for shared custody of Nahla in December.

Halle Berry opts out of starring in a film to prepare for custody battle.

Actress Halle Berry has opted to back out of a role in upcoming movie New Year’s Eve, which is scheduled to shoot this week in New York. The 44 year old actress has to prepare to fight for custody of her daughter instead.

The Oscar winning actress and her ex-boyfriend, Gabriel Aubry share a daughter, Nahla, who will be three in March. The couple seperated last year after meeting in 2005 at a fashion shoot. Berry also has an adopted daughter, India, with ex-husband musician Eric Benet.

Katherine Heigl, formerly of Grey’s Anatomy, is rumored to be replacing Berry in New Year’s Eve.
